Effective
The short version: connect only your own WHOOP, share only what you choose with your group, try Pro free for 7 days, and get your money back within 30 days if it isn't for you. The app is not medical advice and not for emergencies.
Who we are
Am I sleeping? (amisleeping.com, “the app”) is made by Sergey Petrov (Sergey Baus), an individual developer in Spain. These terms are between you and him. Questions: sergey@goodit.works.
Who can use it
You must be 18 or older, or the age of majority where you live, and have your own WHOOP membership.
What the app is, and is not
The app puts your WHOOP data in your calendar and lets the people in your group see whether you're asleep or awake. It is not medical advice, not a medical device, and not for emergencies or safety monitoring. “Probably asleep” is an estimate from your recent nights and can be wrong; data can arrive late or not at all. Don't rely on it to decide whether someone is safe. The app is not affiliated with WHOOP. Data by WHOOP.
Connecting and your group
- Connect only your own WHOOP account, and follow WHOOP's terms.
- Sharing is always your choice. No one, including an employer, a partner or a family member, may require you to share, and you may not require anyone else to. Don't use the app for employee monitoring or to keep watch over someone.
- Anyone with your group's invite link can join it and see what you chose your group sees. Remove someone, leave or pause, and new updates stop at once; copies in a calendar app can stay for up to a day, or for good if someone downloaded the file.
If you're in someone's group
Use what the group shares only to know when its members are asleep or awake. Don't pass the link on, publish it, or collect or resell its data, and leave if they ask. Members with a WHOOP can remove you at any time without telling you. Watchers never pay.
Plans and the free trial
- Pro: $4 a month or $29 a year. It starts with a 7-day free trial, one per WHOOP account. A card is required at checkout. Cancel before the trial ends and you are not charged; otherwise the plan you picked is charged when the trial ends and renews every month or year until you cancel. Cancel any time from your dashboard; Pro keeps working until the end of the period you paid for.
- Lifetime: $49 once for the first 50 buyers, then $69. Lifetime means everything in Pro for as long as the app operates. The app depends on WHOOP's API. If WHOOP ends our API access within 24 months of your purchase, you get a pro-rata refund of the unused part of those 24 months, and we tell you as soon as we know that access is ending. Lifetime has no trial.
- Group discount: 10% off Pro for each extra member with a WHOOP in your group, up to 30%. Members count while they have a plan, a trial or Lifetime; watchers never count. Each member pays their own plan. When the number changes, the new discount applies from each member's next renewal, with no proration and no refund for the current period; a new subscription gets the group's discount from its first charge. Lifetime is never discounted, and it counts toward the group.
Without a current plan, the app stops updating: your calendar shows a note instead of your data, and your group sees that you paused sharing. A new plan brings everything back.
Payment
The app is sold by Sergey Petrov, an individual developer, through Link, Stripe's merchant of record (Sold through Link, LLC). Link takes the payment, works out and pays the sales tax or VAT, and sends the receipts and trial emails, under its own terms. Your card statement shows LINK.COM*. Prices are in US dollars. They are final and include tax; checkout may show them in your currency.
Refunds
A full refund within 30 days of any payment, no questions asked: write to sergey@goodit.works from the email you paid with. If you are a consumer in the EU or the UK, this also covers your 14-day right to withdraw. Link's support can also refund within 60 days in the cases its terms cover.
Fair use
Don't try to reach other people's data, overload the service, scrape it, or get around its limits or the trial rule. We may suspend an account that does, and tell you why.
Changes and availability
WHOOP's API can change, and so can the app. We email you at least 30 days before a change to these terms that affects you, and before the app closes. You can delete your account at any time from your dashboard.
Liability
The app is provided as it is. As far as the law allows, our total liability to you is limited to what you paid us in the 12 months before the claim. Nothing here limits liability that the law does not let us limit, such as for intent, gross negligence, or death or injury caused by negligence.
Law
Spanish law governs these terms. If you are a consumer, you keep the protection of the mandatory consumer laws of the country where you live, and you can bring a claim in its courts.
